A new year and new fining powers for the MoJ's claims management regulation unit (CMRU). But how does this affect personal injury solicitors dealing with CMCs?

We discussed this issue with Michelle Garlick, partner and head of Compli, as part of our '60 seconds with...' feature for this week's Compli newsletter:

Michelle, should law firms be concerned about the new regime for fining CMCs acting in breach of the rules?

This reinforces the need for all personal injury law firms to review and consider their arrangements for case acquisition. I would not be at all surprised if the SRA keeps a close eye on any fines made against CMCs and then asks questions of any firms dealing with such companies. Given that intelligence may also arrive at the SRA from the Legal Ombudsman now the latter is dealing with complaints made against CMCs, thorough due diligence by law firms is essential!
