A claims management company (CMC) made the headlines recently for all the wrong reasons after it was fined £80k by the Information Commissioner's Office (ICO) for making unwanted nuisance calls.

Adam, what did you think about the ICO's decision to fine the CMC?

I was glad! We all receive these calls, even where we have registered with a telephone preference service, and they are a complete nuisance. It is comforting to know that the ICO is taking such flagrant breaches seriously and sending a message to unscrupulous businesses.

Any law firm which dealt with the CMC should carefully consider whether their arrangements amount to a material breach which must be reported to the SRA. Existing arrangements must also be carefully assessed and proper due diligence must be carried out on all prospective introducers. For a confidential chat, please get in touch.
